Master Terms & Advertising Agreement

This page serves as the canonical Terms & Disclaimer and the Exclusive Advertising Agreement for BusinessForSaleInBC.ca (the “Platform”). Any forms or checkout pages that reference our Terms or Agreement incorporate the provisions below by reference.

1) Who We Are

BusinessForSaleInBC.ca provides advertising space for business-for-sale listings and is operated by licensed real estate professionals in British Columbia. Some listings are posted by third-party advertisers (licensed Realtors® and brokerages, “Exclusive” listings), some are MLS®/VOW listings from other brokerages, and some are listings represented by our team.

2) Scope of Services (Advertising Only; Not Agency)

The Platform provides paid advertising space for business-for-sale listings (“Exclusive Ads”). We are not your brokerage or agent unless you have signed a separate, written representation agreement with our brokerage and a licensed Realtor® from our team. Advertising on the Platform does not create an agency or fiduciary relationship and does not constitute an endorsement of the advertised business.

3) Authority & Eligibility to Advertise

We currently accept advertising submissions only from licensed Realtors® and brokerages, or from their authorized staff/associates acting on their behalf. By submitting a listing, you confirm you are duly licensed and authorized by the owner or the listing brokerage to advertise and you will provide proof of such authority (e.g., signed owner or brokerage consent) upon request. Direct owner submissions are not accepted unless the owner is represented by a licensed Realtor® who submits the advertisement.

4) Submission, Publication Timeline & Term

After complete submission (including proof of authorization) and payment, listings are generally reviewed and posted within 3–7 business days. Each ad runs for the purchased term (1, 3, or 6 months) beginning on the date of publication.

5) Fees & Refunds

Advertising fees are per listing and payable in full prior to publication. Fees are non-refundable once the ad is live. Applicable taxes may apply.

6) Inquiries & Buyer Representation

Inquiries submitted on Exclusive Ads are forwarded to the advertiser’s contact email or their authorized representative. Because the Platform is operated by licensed Realtors®, our team may also contact inquirers who request assistance to offer buyer representation, where permitted by law and where no conflict of interest exists, and will provide required BCFSA disclosures. Advertisers acknowledge and agree that buyer inquiries are not exclusive to them.

7) Content Standards; Approval; Edits, Refusal or Removal

Advertisers are solely responsible for the accuracy and legality of all information, photos, and documents provided. We may edit layout, categorization, or formatting for clarity and consistency. We reserve the right, in our sole discretion, to review, approve, edit, refuse, suspend, or remove any advertisement at any time for any reason, including but not limited to non-compliance with our policies, misleading or unlawful content, payment issues, intellectual property concerns, conflicts with our professional standards, or regulatory requirements. Submission of an advertisement does not guarantee publication, even if the content appears to meet stated requirements.

8) Confidential Listings

If you mark your listing confidential, do not include sensitive or identifying business details in the public advertisement. Such information may be shared privately by the advertiser with serious buyers (e.g., subject to a non-disclosure agreement).

9) Limited License to Display Materials

You grant us a limited, non-exclusive, worldwide license to display and distribute the submitted text, images, and logos on the Platform for the duration of the ad term and for reasonable archival, recordkeeping, and portfolio purposes.

10) Our Seller Client Listings

Where we represent the seller, we cannot represent the buyer in the same transaction. Buyers may proceed unrepresented or engage their own Realtor®. For unrepresented buyers, we will provide factual information only and will deliver the required BCFSA disclosures, including the “Disclosure of Representation in Trading Services” and “Disclosure of Risks to Unrepresented Parties.”

11) MLS® / VOW Listings

MLS® listings displayed on this site are provided by participating REALTOR® members and are deemed reliable but not guaranteed. Unless otherwise stated, we do not represent the seller of MLS® listings and may represent you as a buyer if you choose to work with us.

Note: Exclusive listings belonging to our team are not necessarily paid advertisements and may be added to our website for exposure. In such cases, the listing will display the appropriate disclosure and clearly state who it is listed by.

12) Privacy & Communications

Your information is handled per our Privacy Policy. If you optionally consent in our forms, you may receive marketing and promotional messages (frequency varies; message/data rates may apply). You can opt out at any time.

13) No Guarantees

We do not guarantee inquiries, buyer interest, lead volume, search rankings, or sale outcomes.

14) Limitation of Liability

To the maximum extent permitted by law, our total liability related to an advertisement is limited to the amount you paid for that ad term.

15) Changes to These Terms

We may update these Terms by posting a new “Last updated” date at the top. Material changes apply prospectively unless otherwise stated.

18) Platform Rights & Discretion

The Platform is privately owned and operated. We may at any time modify available advertising products, pause or discontinue acceptance of new advertisements, or limit access to advertising features or categories. We are under no obligation to provide reasons for a refusal or removal decision. Any prepaid fees for unpublished ads will be refunded; fees for ads that have gone live remain subject to Section 5.
